Information according to article 13 General Data Protection Regulation (GDPR) for applicants

Compliance with data protection regulations is very important to our company. We would like to inform you below how we collect your personal data:

Responsible body:

Data required for the purposes of the employment relationship:

As part of the application process, we collect and process your personal data that is necessary for the decision to establish an employment relationship. This includes, in particular, contact data such as name, address and telephone number or email address as well as all data related to the application, such as CV, certificates, qualifications, answers to questions, etc. We also collect and process your bank details to reimburse travel expenses. The legal basis for the processing of your data results from article 88 GDPR in conjunction with section 26 paragraph 1 sentence 1 BDSG (German Federal Data Protection Act) or article 6 paragraph 1 sentence 1 lit. b GDPR.

We also collect and process personal data that you voluntarily provide to us. This applies, for example, to information about severe disabilities if we request this for the purpose of fulfilling our obligation under Section 154 SGB IX (Ninth Social Code) (employers' obligation to employ severely disabled people). These fields marked as voluntary or optional do not need to be filled out.  This data is processed on the basis of your revocable consent in accordance with article 6 paragraph 1 sentence 1 lit. a, article 7 GDPR in conjunction with section 26 paragraph 2 BDSG.

After the retention periods have expired (see “Data deletion” below), we anonymize your personal data for the purpose of statistical analysis. Personal data such as names or individual documents are automatically deleted from our applicant management system and purely statistical data such as gender or the specific position are stored in aggregate. The legal basis for this is our legitimate interest in statistical evaluation to determine personnel-related key figures with which we comply with our legal and official obligations in accordance with article 6 paragraph 1 sentence 1 lit. f of the GDPR

 

Applicant pool:

If you have not been hired but your application is still of interest to us, we may ask you whether we may keep your application on file for future vacancies. This longer storage period is based on your revocable consent in accordance with article 6 paragraph 1 sentence 1 lit. a, article 7 GDPR in conjunction with section 26 paragraph 2 BDSG. Inclusion in our applicant pool is voluntary and failure to provide the consent has no impact on other ongoing application procedures.

Data deletion:

In principle, we only process your data for as long as it is necessary for the purposes for which it was collected, or as long as we have a legitimate interest in storing it. Unless you are hired, your data will generally be deleted no later than four months after completion of the application process or after receipt of the rejection.

We store applications that we have included in the talent pool for one year. The documents will then be deleted. We will keep your declaration of consent to be included in our talent pool for a further three years in order to comply with our accountability obligations within the meaning of article 5 paragraph 2 GDPR.

In individual cases, individual data may be stored for a longer storage period if retention periods prevent deletion (e.g. in the case of reimbursement of travel expense). The storage period then depends on the legal retention obligations, for example from the German Fiscal Code (6 years) or the German Commercial Code (10 years). The data processing is then carried out on the basis of article 6 paragraph 1 lit. c GDPR in conjunction with the relevant standards from the German Commercial Code and the German Fiscal Code. Further storage of your data is also permitted if further processing is necessary for us to assert, exercise or defend legal claims after weighing up our interests.

Confidential treatment of your data:

We will of course treat your data confidentially and will not pass it on to third parties.

We are obliged to inform the works council about the application process, to provide the necessary application documents and to provide information about the persons involved (section 99 (1) of the Works Constitution Act). Your personal data will be transmitted to the works council for the purpose of fulfilling these participation and co-determination rights.

If necessary, we use service providers who are strictly bound by instructions, for example, in the areas of IT (D.Vinci HR-Systems GmbH, Hamburg) or the archiving and destruction of documents and with whom separate contracts for order processing have been concluded.

Your data protection rights:

As a data subject, you have the right to information about the personal data concerning you (article 15 GDPR) as well as to correct data (article 16 GDPR) or to delete if one of the reasons stated in article 17 GDPR applies, e.g. if the data is no longer required for the purposes pursued. You also have the right to restrict processing if one of the conditions specified article 18 GDPR is met and in the cases set out in article 20 GDPR the right to data portability.
